In compliance with the Federal Law for the Protection of Personal Data Held by Private Parties, American Society of Mexico, A.C. (hereinafter, “the Association”), with domicile at Bahía de Ballenas 72, Col. Verónica Anzures, Alc. Miguel Hidalgo CDMX, Mexico City, CP: 11300, informs its affiliated companies that data and information shared will be processed under the principles of lawfulness, consent, information, quality, purpose, loyalty, proportionality, and accountability, ensuring at all times their confidentiality, safeguarding, and ethical use.
1. Purposes of information processing
The information provided by affiliated companies will be used exclusively for the legitimate purposes of the Association, including:
- Administration and update of the affiliate registry.
- Institutional communication regarding events, programs, initiatives, surveys, and activities of common interest.
- Development of sectoral analyses, impact studies, and generation of non-individualized statistical content.
- Promotion of collaborative ties among affiliated companies, always respecting their autonomy, privacy, and competition rules.
2. Confidentiality commitment
The Association acknowledges that the information provided by its affiliates may contain strategic, commercial, financial, or operational elements, and therefore:
- All information will be treated as strictly confidential, unless expressly stated otherwise by the affiliate.
- The individual information of any affiliated company will not be disclosed, transferred, or commercialized to third parties, except by reasoned request of a competent authority or express written authorization from the holder.
- Any document, data, or comment shared in sessions, committees, surveys, or internal exchanges will be handled responsibly and used solely for previously defined purposes, with an institutional and non-competitive character.
- Personnel, suppliers, and service providers collaborating with the Association are required to sign confidentiality agreements preventing them from improperly disclosing or using any affiliate information.
3. Absolute respect for free competition
The Association acts in full respect of the legal provisions on economic competition and monopolistic practices, therefore:
- It will not promote or facilitate agreements, recommendations, or practices among affiliated companies that limit competition or violate the applicable legal framework.
- Sensitive information of each affiliate (such as prices, market strategies, customer or supplier data, commercial conditions, etc.) will not be shared, discussed, or promoted in institutional spaces of the Association.
- In meetings, committees, or working groups, any exchange of information that could be interpreted as coordination of commercial actions among competitors will be avoided.
- At all times, an environment of ethical, transparent collaboration will be fostered, aligned with the principles of plurality, equity, and mutual respect.
4. ARCO rights
Affiliated companies may exercise their rights of Access, Rectification, Cancellation, or Opposition (ARCO) regarding their data by submitting a request to the Association at the email address derechos.arco@funcionpublica.gob.mx or at Barranca del Muerto 209, Planta Baja, Colonia San José Insurgentes, Alcaldía Benito Juárez, Mexico City, Postal Code 03900.
5. Modifications to this notice
The Association reserves the right to modify this Privacy Notice to adapt it to regulatory or operational changes. Any modification will be duly notified through official channels, including the website and direct communications.
